On April 15th, Singleton Schreiber, LLP filed the first lawsuit on behalf of a resident displaced by the deadly fire at Waterstone Apartments in Fremont.
The Waterstone Fire ignited on the 4th floor of Building 25 around 3 a.m. on April 6th, killing two residents and injuring several others. All 30 apartment units in the building were evacuated and left uninhabitable due to severe smoke, fire, and water damage. The plaintiff and all other Building 25 residents are unable to return to their homes and continue to face challenges arising from the fire.
The suit names both the building owner and the property manager as defendants, alleging that:
- The defendants negligently maintained the premises.
- The property had a clearly visible, dangerous, and hazardous condition on the property at the time of the fire that created an unreasonable risk of injury.
- The defendants failed to notice the condition, failed to take remedial action to remove or repair the dangerous condition, and failed to reduce or eliminate the risk of injury.
