SAN DIEGO, CA—A lawsuit was filed by a female plaintiff (Jane Doe) against Mellow Massage, LLC; Mellow Massage Pacific Beach, LLC; and massage therapist Cristian Rojas, alleging sexual assault, battery, and negligence at the Pacific Beach massage parlor.
The incident took place on May 14, 2025, when Jane Doe visited the Mellow Massage parlor at 909 Grand Avenue, believing she was booking a routine lymphatic drainage massage. During her appointment, Rojas sexually assaulted her while she was alone in a private room. Jane Doe immediately reported the assault to the authorities and sought medical care, including a sexual assault examination.
The lawsuit further claims that Mellow Massage and its affiliated companies failed to properly vet Rojas, despite previous reports of sexual assault and inappropriate behavior at their facilities. Rojas made comments to Jane Doe indicating he regularly touched clients in a sexual manner and in the way he assaulted her. Mellow Massage’s alleged failure to properly supervise Rojas and their neglect of earlier complaints enabled his continued abuse. Additionally, Jane Doe further alleges that Mellow Massage did not take appropriate action following the incident and failed to offer immediate remedies or to even give a refund.
“Despite previous reports of sexual assault and inappropriate behavior by therapists at Mellow Massage, Defendants failed to properly screen Rojas, failed to adequately supervise him, and failed to implement necessary safety policies and procedures,” said Meagan Verschueren, attorney for the plaintiff at Singleton Schreiber. “These failures directly enabled our client's assault and for Rojas to go on and continue assaulting members of the public. We are seeking justice for our client and hope this case sends a clear message that businesses must prioritize the safety of their patrons.”
The suit includes charges for sexual battery, negligence, and violation of California’s Civil Code, among other claims. The lawsuit seeks compensatory and punitive damages for sexual assault, negligence, and intentional infliction of emotional distress, along with special damages, litigation costs, and expert fees.
