Singleton Schreiber Files Two Additional Lawsuits Against Homewood Massage Therapist and Escape Day Spa Alleging Sexual Assault
BIRMINGHAM, AL – Singleton Schreiber has filed two additional civil lawsuits on behalf of two more survivors sexually assaulted by Matthew Owen Jones while he was acting as a massage therapist for Escape Day Spa in Homewood, Alabama. These assaults occurred after the spa had already been alerted that Jones posed a danger to customers. The new filings are on behalf of plaintiffs "Beta" and "Delta" (pseudonyms used to protect their identities).
A first survivor, "Alpha," disclosed a sexual assault by Jones to Escape Day Spa on July 2, 2025, the same day it occurred. Beta's assault happened more than six months later, on January 6, 2026. Delta's assault happened nearly a year later, on June 16, 2026. Both lawsuits, filed in the Circuit Court of Jefferson County, Alabama, name Jones and Escape Day Spa as defendants.
Plaintiff Beta alleges that on January 6, 2026, she was booked for a deep tissue massage at Escape Day Spa, located at 100 Broadway St. in Birmingham, and that Jones subjected her to non-consensual sexual contact over the course of the ninety-minute appointment. She was unable to physically resist or confront him out of fear and shock.
Plaintiff Delta alleges that on June 16, 2026, she and her spouse were booked for a couples massage as a gift from a family member. Jones was assigned to Delta while a female therapist worked on an adjoining table with her spouse. Delta alleges Jones subjected her to non-consensual sexual contact despite her repeated protests, telling him directly that he was hurting her and demanding he stop. Delta says Jones only stopped when the buzzer signaling the end of the session sounded. She and her spouse went straight to the front desk afterward to report what happened and ask for a manager, but were told the manager had already left for the evening. Delta and the family member who had purchased the massage then made repeated attempts to reach the spa's owner or manager directly to report the incident.
Both lawsuits allege that Escape Day Spa knew of Jones’ prior conduct with survivor “Alpha” and continued to give him unsupervised access to customers. The spa was also aware that at one time Jones’ license was expired, but continued to employ Jones and allowed Jones to provide massage therapist services.
"Our investigation continues to reveal that Escape Day Spa was made aware on multiple occasions that they employed a dangerous massage therapist. They failed these survivors when they failed to act and instead continued to expose their clients to Jones," said Sara Williams, Executive Partner at Singleton Schreiber.
